  1. The contract

This document sets out the T&Cs upon which we operate our flight simulator experiences.

A legally binding contract with you will only come into existence when you have paid the amount we request for your booking and we have sent written confirmation of your booking to the postal or email address you have supplied.

Any changes or additions to these T&Cs must be agreed in writing.

  1. Booking information

When we send you written confirmation of your booking we will include details of the experiences included in your booking, the price payable for the booking and the date scheduled for the experience you have booked. Participation date must be arranged and scheduled within 6 months of purchase, after which bookings will be cancelled and no refund given.

Flight Gift Vouchers are valid for 6 months from the date of purchase, after which they will be canceled and no refund given.

Flight Gift Vouchers are valid only for the experience detailed thereon and are not redeemable for any other service or value.

If flight time is reduced for any reason attributable to you (for example late arrival, motion sickness, toilet breaks etc), City View Digital Media Ltd. will not reschedule or refund this time.

  1. Your cancellation rights

You have the right to cancel your booking at any time up to the earlier of:

  • 14 days after the day on which the contract is concluded; and
  • 24 hours before the date scheduled for the experience you have booked.

To exercise the right of cancellation, you must give written notice to us by email at flightstudio@andrewsfield.com

We will refund all monies received within 14 days of cancellation.

  1. Requirements for participation

We will need to assess whether you or the person for whom you make your booking meets our requirements for participation. To help avoid disappointment we recommend that you come to visit us and discuss any potential issues, before making a booking. This will give us the opportunity to give you an indicative assessment whether you are likely to meet our requirements for participation, which include (but are not limited to) the following:

  • Participants in experience must be over the age of 12. Any person under 18 must be accompanied by an adult.
  • Whilst we will use all reasonable endeavors to accommodate you, there are potential space and access issues that may prevent participation.
  • You must be in good health and free from heart, back and neck problems, motion sickness or any other condition that could be aggravated by the simulator.
  • You should dress comfortably and not wear heels.
  • In the interests of safety, you will need to complete a medical questionnaire before undertaking an experience.
  • You will not be permitted to participate in any experience if you are under the influence of drugs or alcohol.
  • We will require sight of photographic identification in the form of a passport or driving license prior to participation in an experience.
  1. Problems with bookings

If we are unable to fulfill your booking for any reason beyond our reasonable control, we will promptly notify you in writing by the postal or email address you have supplied and endeavor to arrange an alternate booking which is reasonably acceptable to you. If this is not possible you will be entitled to cancel the booking, in which case we will promptly refund you all sums paid.

If technical difficulties are encountered during the flight and the duration is reduced, the participant will be offered an alternative date to complete the flight or a pro-rata refund of the time.

  1. Charges

You will need to pay the full amount when making your booking. If you cancel the booking in a manner other than as set out in these T&Cs, we will forfeit your payment.

  1. Warranty and Liability

We will use reasonable care and skill to provide you with the experience that you have booked.

We will not be liable to you by reason of any delay in performing, or any failure to perform, any of our obligations in relation to your booking if the delay or failure was due to an act of god, power failure or any other cause beyond our reasonable control.

We will not be liable to you for any unforeseeable loss or damages arising from your booking, including loss of profit or consequential loss or damage. Nothing in these T&Cs affects any liability for death or personal injury caused by our negligence or for fraudulent misrepresentation or your statutory rights as a consumer.

Our total liability in respect of any losses arising under or in connection with your booking shall be limited to the payment that you make in relation to your booking.

  1. Data protection

We will only use the personal information you provide for the purpose of providing the experience you have booked, or for informing you of the availability of similar services unless you agree otherwise. You can correct your personal information, or ask for information about you to be deleted, by giving written notification to us in the manner prescribed at clause 3.

  1. Miscellaneous

In the interests of health and safety, we may take a video recording of your experience.

For the avoidance of doubt, you will not gain any qualifications or awards from the experience you book.

  1. General

Nothing in this contract gives any right to any third party to enforce any provision under the Contracts (Rights of Third Parties) Act 1999 or otherwise.

The contract will be subject to English law, and the English courts will have jurisdiction in respect of any dispute arising from the contract.

A lost Flight Gift Voucher will not be replaced or refunded.
